General terms and conditions

Qatar Airways Holidays’ Terms & Conditions of booking (“Booking Conditions”) have to be reviewed and accepted by any customer who is or may be considering the booking of any holiday booking (“Holiday Booking”) including any persons who are booking together (“Customer”) prior to payment for a Holiday Booking to be accepted and confirmed. All persons travelling together will be deemed to have understood and agree with the Booking Conditions. When a Holiday Booking is received through a travel agent, the Customer will be deemed to have understood and agree with the Booking Conditions.

Your Holiday Booking is governed by the Booking Conditions as set out below and by the business terms under which the Holiday Booking is made.

Booking & Payment

  • The Booking Conditions apply to all Holiday Booking including Web-sales, Call Centre bookings or through the nearest Qatar Airways Holidays’ shop.
  • Special conditions apply to group bookings for more than 9 travelers. Qatar Airways Holidays to be contacted for inquiries.
  • Discounts may apply to Privilege Club Member (QRPLATINUM, QRGOLD and QRSILVER) subject to change by Qatar Airways Holidays. Often, cannot be combined with other discount types and cannot be used in conjunction with other promotions and special offers.
  • Full payment is required at the time of booking for confirmation of the Holiday Booking and the issuance of E-tickets and vouchers by Qatar Airways Holidays. In the event of such condition not being met, booking will not be honored.
  • Payments online using Visa, MasterCard, Diners Club & Discover are accepted. Qatar Airways Holidays accept major Debit cards except those issued by banks in Qatar that do not support internet transactions.
  • At our Qatar Airways Holidays’ shops we accept: Cash, Credit Cards and all Debit cards.
  • Holiday Bookings shall be made by Customers above 18 years old at the date of the booking.
  • All Holiday Bookings are subject to, and shall be made in accordance with, the individual terms and conditions and booking requirements of the hotels, tour operators, suppliers and/or handling agents as applicable. Qatar Airways Holidays shall have no liability to Customer in respect of any loss or damage caused as a result of the booking not being made in compliance with such terms and conditions, including but not limited to any minimum age requirements.
  • Customers below the age of 21 years old at the date of the booking are advised to enquire directly with the hotels, tour operators, suppliers and/or handling agents to ensure that they comply with the minimum age requirements and are eligible to the Holiday Booking.

  • Charges may apply to subsequent /cancellations as per the cancellation policy applicable to land services by vendor and/ or as per the applicable fare rules of the flights. Details of the applicable cancellation policy will be provided at the time of the Holiday Booking and stated under the “important information” icon.
  • Charges may apply to subsequent alterations/amendments as per the applicable rules displayed at the time of the Holiday Booking in addition to a service fee of QAR 100 or equivalent shall apply All changes are subject to availability of rooms and/or flights on the new dates.
  • Once the travel has commenced there is no refund available on partially used Holiday Bookings. For fully unutilized Holiday Bookings, any refund will be subject to Qatar Airways Holidays receiving a refund from the hotel or supplier and administration fees of 7% will apply.
  • Qatar Airways Holidays reserves the right to levy 7% service and handling charges on an individual Holiday Booking basis, even if a Holiday Booking is cancelled within the acceptable period.
  • Transfers and tours once confirmed are non-refundable. Cancellation of the service will result in 100% charges. Cancellation policy is subject to supplier's terms and conditions.

Availability & rates

  • Qatar Airways Holidays reserves the right to revise prices should there be a major fluctuation in rates of exchange, airfares or both.
  • Any applicable local city taxes to be paid directly at the hotel.
  • All prices quoted are subject to change without prior notice. Hotels and overseas suppliers reserve the right to amend the price of a package, if affected by circumstances beyond their control and hence increasing the price accordingly. Any increase in price would have to be paid prior to departure. Such increase will not normally apply when a Holiday Booking is confirmed after full payment is received.
  • Every effort will be made to confirm a Holiday Booking exactly as per the Customer’s request; however in case of non-availability, Qatar Airways Holidays reserves the right to offer similar alternatives.
  • In the event hotels, overseas tour operators, suppliers & handling agents exercise the right to amend, alter, change or withdraw any tour, excursion, itinerary, holiday package or booked facility, the Customer shall have the right to (i) accept and continue with the tour or Holiday Booking as amended or altered (ii) decline the alternative hotel, tour or holiday which the tour operator, supplier or handling agent may offer. In neither of these cases shall Qatar Airways Holidays be liable to the Customer for damage, additional expense or consequential loss suffered by the Customer.

Limitation of Liability

  • Qatar Airways Holidays makes and confirms Holiday Bookings on behalf of hotels, overseas tour operators, suppliers and handling agents providing accommodation, travel, cultural and/or sporting activities or other services acting as independent contractors and not as agents or employees of Qatar Airways Holidays. Hence, Qatar Airways Holidays has limited liabilities only in terms of the arrangements directly under its control.
  • Qatar Airways Holidays shall under no circumstances be liable to the Customer or any person travelling with him/her for (i) any death, personal injury, property damage, sickness, accident, loss, delay, increased expense, consequential loss or any misadventure howsoever caused, (ii) any act, omission, default of any hotelier, carrier, overseas tour operator, suppliers, handling agents or other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage, facility, any cultural and/or sporting activity, or any other service for the Customer or for any person traveling with him/her howsoever caused, (iii) the temporary or permanent loss of or damage to baggage or personal effects howsoever caused.
  • The Customer participating in any cultural or sporting activity provided by any hotels, overseas tour operator, suppliers and handling agents fully acknowledges, understands and assumes the risk(s) involved by such activities including the risks of death or injury to himself/herself and damage to his/her property or to any persons traveling with him/her and their property. The hotels, overseas tour operators, suppliers and handling agents providing activities or services which include a risk of such nature may at their own discretion, require the Customer to sign their liability waiver prior to, and as condition of, participating in the activity or service they offer.
  • Qatar Airways Holidays shall not be responsible nor deemed to be accountable by default for any delays or interruptions in the performance of its obligations due to causes beyond its reasonable control or not occasioned by its fault of negligence, which includes acts of God or the public enemy, war, civil war, warlike operations, blockade, terrorism, insurrections or riots, fires, flood (unusually) severe weather conditions, epidemics or quarantine, restrictions, any political or government, strikes or labor unrest causing cessation, slow down or interruption of work (collectively “the Force Majeure events”).
  • In the event the Customer is not satisfied with the hotel or room on check-in, a complaint needs to be registered onsite with the hotel front-office, so that it may be addressed, locally by the hotel. In the event the Customer chooses to check-out, refund (if any) shall be subject to the approval of the hotel. In the event of disputes over such and all other circumstances, Qatar Airways Holidays will offer all reasonable assistance but will not be responsible for carriage of any claims and for any compensation.

Specifications and preferences

  • While hotels offer triple-share occupancy rates, the room provided is generally a typical double room with an extra bed or a rollaway bed, for the third person. Such triple share arrangements may reduce the space in the room and could cause some discomfort.
  • Bed types provided in the room are subject to availability and at the discretion of the hotel. Qatar Airways Holidays will not be held liable for non-availability of requested bed type.
  • The categorization of hotels, resorts and other types of accommodation is generally done by the Tourism body of the respective country and the process of the rating/grading used to categorize the properties may not necessarily conform to international standards, Qatar Airways Holidays does not take responsibility if the rating/grading of the hotel does not conform to international standards.
  • Car rentals are based on the vehicle category and not by car make or model. The vehicle category/group is only a classification-system, used by car rental companies, according to the vehicles in the fleet, based on the size and number of doors and is an indication of the vehicle features, seating and luggage capacity which should be used as a guideline only. At the time of collection of the car, a valid credit card (for guarantee) and an international driving license has to be provided, however these terms are subject to change. Refer to respective booking terms at the time of selecting the service.
  • The standard check-in time at the hotels is after 1400 hours on the day of arrival (local time in the destination) and check-out time is 12 noon on the day of departure, certain properties may have different policies and shall be adhered to.
  • Late check-out subject to room availability and cannot be guaranteed, charges may apply locally by the hotels.

Travel Documents

  • It is the responsibility of the Customer to obtain and carry a valid passport and other travelling documents including visas (Multiple entry visas are recommended), permits, vaccination certificates, etc. Qatar Airways Holidays shall not be liable for any inconvenience, expense, loss or damage of any kind, if incurred by the Customer due to failure of obtaining or producing such documents.

Service and handling charges

  • All Holiday Bookings are subject to a non-refundable service charge of QAR 100 or equivalent per Holiday Booking and/or any amendment of existing bookings. (Web-bookings are excluded).

Insurance

  • Qatar Airways Holidays strongly recommends the purchase of an adequate holiday insurance to cover unforeseen eventualities.

Limitations on Use

  • All information contained in this website has been provided to Qatar Airways Holidays by tourism boards, destination management companies, suppliers and hoteliers. While every reasonable effort has been taken to ensure that the information contained herein is accurate, Qatar Airways Holidays does not take responsibility for any information provided by third parties and/or changes to such information.

Data protection policy

  • Any personal data has been given to us for the purpose of purchasing a Holiday Booking, making a hotel reservation, booking ancillary services, facilitating immigration and entry requirements and making such data available to government agencies in connection with the Holiday Booking. For these purposes, Customers authorize us to retain and use such data to transmit it to our own offices, suppliers, authorized agents, government agencies, other carriers or the providers of such services, in whatever the country they may be located in accordance with Qatar Airways Holidays’ Privacy Notice.

Complaints & Feedback

  • We are conscious of the expectations of our Customers and certainly try our best to meet such expectations. While all our team members are professionally trained and entrusted to deliver outstanding levels of customer care, we take Customer feedback and reports seriously and such priorities are taken into account in our desire to provide the best possible service for continuous improvement. All complaints should be submitted in writing to Qatar Airways Holidays within 30 days of return. Qatar Airways Holidays may reject any claims after the valid time frame.

Quarantine Packages Terms and Conditions

  • All hotels offering ‘Quarantine Packages’ are exclusively reserved for Qatari Nationals, GCC Nationals, their travelling companions, those with a Permanent Resident Card or other exceptionally approved Visa holders and for non-Qatari National residents & QID holders authorized to return to Qatar for the mandated period of 7 day quarantine.
  • From 1300 local time 22 December: If you are arriving from 23 December on a flight originating from or transiting via the UK, Denmark, Netherlands or South Africa you need to purchase a UK, Denmark, Netherlands or South Africa Arrivals Quarantine Hotel. Any other Quarantine Hotel Package purchased after 1300 local time 22 December onwards will be cancelled with 100% cancellation fees.
  • If instructed to extend stay by MOPH in the hotel beyond the mandated 7 quarantine period then the customer will be liable for any additional costs related to the extended stay in the hotel
  • Hotels are licensed based on adherence to governmental quarantine protocols: please refer to Qatar Clean for further information https://www.qatarclean.com.
  • Customers are strictly required to stay in their rooms.
  • Hotel facilities such as swimming pool, recreational areas, gym etc are not accessible to customers.
  • All other quarantine protocols are applicable.
  • Only Quarantine Packages are available for booking, which consist of:
    1. Hotel accommodation for the number of nights stated
    2. Airport to hotel transfers (Not applicable to land arrivals via Abu Samra border)
    3. Full Board
  • Special dietary requirements are to be communicated at hotel check-in.
  • Stay is valid for Qatari Nationals, GCC Nationals, their travelling companions, those with a Permanent Resident Card or other exceptionally approved Visa holders, QID holders and Personal Visit Permits with Exceptional Entry Permits for all arrivals.
  • Offer applicable to the selected room category and listed hotels only.
  • No discounts apply (promo or voucher codes).
  • Starting-from prices mentioned are based on minimum two guests staying together unless the offer states otherwise.
  • Price and availability of the hotel offers are subject to change without prior notice. Only one room type is available for booking as part of the “Quarantine Package”.
  • In order to redeem this offer it is the responsibility of the customer to provide the following information accurately, and to be able to produce the documents on request at any stage of travelling from your current destination to the hotel:
    1. Valid Qatari Passport or Qatar ID
    2. QID holders must have an approved Exceptional Entry Permit to return to Qatar, from Qatar Portal
    3. Hotel confirmation voucher as sent by Qatar Airways Holidays in partnership with Discover Qatar
    4. An outbound airline ticket can only be purchased after your Quarantine hotel has been purchased, where required. (Not applicable to land arrivals via Abu Samra border)
    5. There is a daily cap on arrivals; please do not make your travel plans until you have secured your QID return permit and then, if required, your hotel quarantine package. If you cannot see any availability on the website on your preferred day of travel then the daily cap has been reached. Please search for availability on another day.
    6. Amendments to quarantine bookings will not be possible, unless your flight is cancelled. The only exceptions will be under the circumstances above where the airline has cancelled your flight. All other bookings are subject to 100% cancellation.
  • Qatar Airways Holidays and Discover Qatar will not be liable for any inconvenience, expense, loss or damage of any kind if incurred by the customer due to the failure to provide accurate information at the time of booking, or failure to produce such documents when requested.
  • Luggage space is limited to one piece of checked in luggage and one piece of hand luggage per passenger. Increased luggage allowance is available to pre-book. If a customer has not pre-booked the correct amount of luggage allowance, they will be charged for the transfer of any additional luggage outside their allowance. (Not applicable to land arrivals via Abu Samra border)
  • Refunds to be claimed within 6 months from the check out date.
  • Refunds may take up to 60 days to receive in exception to Discover Qatar & Qatar Airways Holidays General Terms and Conditions.
  • We reserve the right to change your pre-booked hotel to another hotel of the same star rating category.
  • Children aged 7 years and above are considered as adults.
  • Two adults and one child under 7 years can be accepted in one Double room.
  • Extra-bed or baby cot for children aged 0 to 6 are subject to availability at time of check in.

  • Domestic staff, company sponsored and other workers quarantine packages are exclusively reserved for domestic staff, company sponsored and other workers returning to Qatar for a mandated period of 14 days quarantine, as mandated up to 15 February 2021.
  • Domestic staff, company sponsored and other workers quarantine packages can be booked online for up to 9 guests (maximum 3 per single booking). 10 guests or more of same gender can be booked as a group:
  • Bookings for Mekaines Motel Quarantine Packages should only be made if your Exceptional Entry Permit shows ‘Type of Quarantine : Mukaynis / Mekaines’
  • Group bookings follow specific payment terms. Please contact us for more information. Domestic staff, company sponsored and other workers quarantine packages consist of:
    • 14 nights’ accommodation in either Male Only or Female Only rooms.
    • Single use rooms or shared accommodation can be booked.
    • Airport to accommodation transfer 
    • Full board – breakfast, lunch and dinner
    • A provision of QAR 700 per person (shared accommodation) / QAR 1400 per person (single room) is payable at the time of booking in case of MOPH mandating up to 1 additional week extension of the quarantine period for individual bookings. This will be refunded in full or pro rata depending on any extension required beyond 14 nights.
    • In the event that MOPH mandate an extension beyond a 21 day period for any reason, the customer or sponsor will be liable to pay for the extra nights incurred
    • A supplement of QAR 235 per person is payable to guarantee access to a mobile phone and SIM card on arrival at Hamad International Airport. This is to ensure access to the Ehteraz App on arrival, which is a mandatory requirement for entry into Qatar. If a mobile and / or SIM is not required, a refund can be requested for any unused supplement amount.
  • Gender (Male / Female), Religion (Muslim / Non-Muslim) and special dietary requirements are mandatory requirements to book.
  • Stay Validity : to 15 February 2021 (currently last check-in date).
  • Bookings can be made up to 24 hours prior to arrival.
  • Bookings must be paid in full to be confirmed.

  • Bookings cannot be amended**. Any cancellations will be subject to 50% cancellation charge*. This also applies to any unused quarantine reservations or if you fail to check in on the date of your arrival.
  • Refunds to be claimed within 6 months from the check out date.
  • Refunds may take up to 60 days to receive in exception to Discover Qatar & Qatar Airways Holidays General Terms and Conditions.
  • * The only exception to this condition is if your airline cancels your flight, in which case you will be eligible to amend the dates of your booking once only. Any new quarantine package booked will be subject to availability and the daily arrival limit. Any differential on the package prices will be payable.
  • **For Corporate Groups only, name changes are allowed up to 72 hours before arrival.

Luxury Coastal Cruise of Qatar - Terms and Conditions

Discover Qatar is the service provider for the Whale Sharks of Qatar Cruise and these Terms and Conditions, together with Qatar Holidays general booking terms and conditions (available to view at: https://www.qatarairwaysholidays.com/qa-en/terms.php/)  govern the terms (the “Contract”) between Qatar Holidays and those persons booking and participating (the “Passenger(s)” on the Whale Sharks of Qatar Cruise (the “Cruise”) and any ancillary, excursions or services (together with the Cruise, being the “Services”).

These Terms and Conditions may be changed or updated by Discover Qatar from time to time.

 

1.1 Booking, Payment and Eligibility

 

  1. Bookings should be made through an online enquiry form that will be directed to Discover Qatar’s Reservations Team. Passenger’s will then be contacted by a reservations representative who will collect all relevant information from the Passenger and payment. Discover Qatar’s reservation team will send all booking confirmations, terms and conditions and package details of the contracted Services to the Passenger via email. 
  2. Acceptance of the Contract occurs upon paying the total Contract price of this Service.
  3. After the Services have been paid for in full, the Passenger shall receive a booking confirmation and Ticket(s) and, where applicable, the vouchers (depending on the services and excursions booked).
  4. In the event that a reservation is cancelled, a cancellation fee will apply in accordance with Clause 1.3.
  5. Children under 6 years of age are not permitted on the Cruise.
  6. Passengers under 18 years old must be accompanied by an adult for the duration of the Services.
  7. Disembarkation at some ports may be hard or even impossible for Passengers with limited mobility, particularly in the case of disembarkation by rowing boat and/or in dinghies. Passengers who use wheelchairs must have their own wheelchair and be accompanied by someone who is able to assist them.
  8. Discover Qatar or the Cruise Operator reserves the right to refuse access to Passengers when the Passenger’s state of health is not compatible with the applicable safety regulations, or if the design of the Cruise ship, and/or the port infrastructure and equipment, including the port terminals, makes it impossible for the Passenger in question to board, disembark or be carried under secure conditions, or conditions that are achievable from an operating standpoint.

 

 

 

1.2 Rates, inclusions and exclusions

 

  1. The Cruise will be operated by Compagnie du Ponant (the “Cruise Operator”). The Cruise Operators passenger terms and conditions (available to view here: https://www.discoverqatar.qa/wp-content/uploads/TERMS-AND-CONDITIONS-OF-THE-PASSAGE-CONTRACT-FOR-CHARTER-AGREEMENTS.pdf) shall apply during the Cruise.
  2. The rates of the Cruises are as published on Discover Qatar’s website, per person and include the inclusions stated herein. All rates are exclusive of Value Added Taxes (VAT). In the event VAT or any similar taxes are introduced in the State of Qatar, the corresponding amounts of VAT and/or similar taxes will be added to the prices and rates and borne by the Passenger.
  3. Inclusions
    1. All meals while on board the Cruise ship (from dinner on the day of embarkation to breakfast on the day of disembarkation)
    2. Meals include early risers’ coffee, breakfast served in cabin or in the restaurants, lunch and dinner in the restaurants, mineral water and wines (red, rose, white) during lunches and dinners.
    3. Daily afternoon tea and pastries.
    4. Open Bar “Classic” served in the bars and in the mini-bar of each cabin
    5. Evening entertainment and events
    6. Room service 24h for all staterooms.
    7. A team of Expedition team members and a guest lecturer
    8. Free unlimited WIFI onboard
    9. Transfers from a Designated Meeting Point to Doha Port
    10. All sight-seeing discoveries as stated in the package
    11. All shore excursions as stated in the package
    12. Local guides where applicable
    13. Transfers from the Doha Port to a Designated Meeting Point
  4. Exclusions
    1. Airfares (unless stated) and airport taxes
    2. Any ground Services before and/or after the Cruise other than the ones mentioned in the specific package
    3. Visa expenses (which may include additional administrative charges imposed by the authorities of a country) and/or immigration reciprocity taxes if applicable.
    4. Gratuities to onboard crew, local guides and drivers
    5. Luggage handling
    6. Optional Spa packages
    7. Meals and beverages other than the ones specifically stated under the Inclusions at Clause 1.2.1 above
    8. Laundry services, hair salon and à la carte Spa treatments
    9. Personal expenses, on board medical consultations and drug prescriptions
    10. Cancellation/luggage/assistance/repatriation/medical insurance(s)

 

1.3 Cancellation fees

  1. Within 15 days after the booking is confirmed: no cancellation fees.
  2. From 15 days after the booking is confirmed to 60 days before the start of the Services: 10% of total amount of the Services
  3. From 59 – 30 Days Prior to the start of the Services: 50% of total amount of the Services
  4. Under 30 Days Prior to the start of the Services: 100% of Full Fare total amount of the Services
  5. Passengers will have full flexibility (full refund / no change fees / 110% future credit) for any government mandated covid restrictions, or if the Passenger tests positive and therefore prohibits boarding
  6. All cancellations must be received in writing by Discover Qatar and are not effective until notification has been received. If the holiday has commenced, 100% of the full Contract price is charged. There is no refund for unused Services or if portions of the Services are missed.
  7. No refunds will be given for no-shows.
  8. No refunds will be in the event of interruption or cancellation by any Passenger after the commencement of the Cruise
  9. Name changes and departure date changes are considered reservation cancellations and subject to the above cancellation fees
  10. Any booking changes are subject to a handling fee of QAR 100

 

1.4 Special Offers

  1. Special deals and special offers other than those advertised on the website may be promoted by Discover Qatar or Qatar Airways Holidays. These special deals or offers apply to new bookings only and do not apply to existing bookings unless otherwise stated.

 

1.5 Passports, visas and vaccination certificates

  1. Before entering into the Contract, it is the responsibility of each Passenger to comply, as appropriate, with the administrative and/or health formalities required by the countries involved in the Services, notably but not limited to, those communicated by Discover Qatar and accessible on the website www.discoverqatar.qa
  2. Before entering into the Contract, Passengers should contact the relevant embassies and/or consulates and perform the administrative and/or health formalities required by the countries involved in the Services.
  3. Discover Qatar will in no event be liable for the consequences of a Passenger not complying with police, customs, administrative or health formalities before or during the Services. Any Passenger who is unable to board a flight or the Cruise ship due to not showing the documents required cannot claim a refund or compensation.
  4. Discover Qatar recommends that Passengers check all travel information with the relevant authorities before the date of departure. Discover Qatar advises Passengers to read their government’s latest travel advice online for the destinations chosen. Discover Qatar alerts Passengers to the fact that the information given can change right up until the departure date, and should therefore be checked up and until the time of departure.
  5. Discover Qatar asks Passengers to adjust their behaviour according to the destination; to be vigilant and avoid carrying valuable items when travelling abroad.
  6. Passenger passports may be checked against national and international criminal databases, including those of Interpol.     
  7. Each Passenger should hold a valid identity document (Qatar Identity Document for Qatari Nationals and Residents) or passports as well as the necessary visas and health certificates valid for the duration and the itinerary for foreign nationals.
  8. All Passengers should comply with instructions of the captain of the Ship, and all applicable laws, regulations and customs in the countries they visit during the Cruise.
  9. The Captain shall be entitled to refuse onboard any person with symptoms of COVID-19 before each Cruise begins

 

1.6 Changes to the package

  1. Website Accuracy – Discover Qatar has endeavoured to ensure that the information given on this website about accommodation, itineraries etc., is correct to the best of its knowledge at the time of publishing. However, advertised descriptions and facilities and prices may change. Discover Qatar recommends that Passengers confirm the details of the chosen package at the time of booking. Final details will be shown on the tickets issued following receipt of the full Contract price. Services under the Contract or excursion itineraries may change or be different from those described as a result of local conditions, weather conditions or annual events. Discover Qatar will endeavour to notify Passengers of any material changes prior to the date of departure.
  2. If Discover Qatar Change or Cancel the Services before Departure – Discover Qatar endeavours to provide Passengers with all the Services confirmed at the time of booking. However, arrangements are planned a long time in advance of departure dates, using independent suppliers, over whom we have no direct control. On occasions, changes do have to be made, and Discover Qatar reserves the right to cancel, substitute or amend holiday packages, excursions or any other Services booked under the Contract accordingly.
  3. Force Majeure - Force Majeure means the occurrence of an event that is beyond Discover Qatar’s reasonable control and which could not have been reasonably prevented by Discover Qatar, which includes, but is not limited to: (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (b) natural disaster (including but not limited to flooding, fire, earthquake, landslide), adverse weather conditions, high or low water levels; (c) nuclear or other industrial accident causing environmental pollution or contamination; or (d) change in law, meaning, enactment, amendment (including repeal) in the law or administration of any law in Qatar or any jurisdiction or territory relevant to the booking Contract, which includes changes in statute, regulation, determination, by-law, declaration, licence and the common law as applicable from time to time, including changes or amendments in regulations or access to Services, sites or countries caused by declared epidemic or pandemic events.
  4. Termination of the  Contract or Changes to the Contract Due to Force Majeure - If Discover Qatar, in its reasonable opinion, considers that any Force Majeure event prevents Discover Qatar (whether directly or through its employees, contractors, subcontractors and agents) from lawfully or safely providing any products or Services subject of the Contract with a Passenger, Discover Qatar may immediately by written notice: (a) terminate the Contract (in whole or in part); or (b) change the Passenger’s travel arrangements under the Contract as much as reasonably practicable, to ensure Passenger safety, and invoice the Passenger for any additional costs.
  5. Limitation of Liability in the Event of Force Majeure - In the event of a Force Majeure event making it impossible or unsafe for Discover Qatar to deliver all or part of the holiday package, Discover Qatar will refund the Passenger for the unperformed part of the Contract less any reasonable losses incurred before cancellation. Losses may amount to a substantial proportion of the booking price. Discover Qatar will use reasonable endeavours to minimise losses incurred by Passengers.

 

1.7 Disruption to Itinerary Arrangements 

  1. Itineraries are intended as a guide only and are subject to alteration without notice. Alterations may be necessary for reasons beyond Discover Qatar’s control. If conditions render any routes unsafe for navigation, Discover Qatar reserves the right to provide alternative Services including, but not limited to, accommodation on the docked Cruise ship, operating part of the itinerary by coach, alternative sightseeing or substitute land arrangements.
  2. Discover Qatar will not be liable for any direct or indirect costs that Passenger’s may incur as a result of any event or other factor beyond Discover Qatar’s control which necessitates a change in itinerary.
  3. Passengers are not entitled to any refund or compensation for any alterations to the itinerary that are caused by events beyond Discover Qatar’s control. Passengers should note that where disembarkation is necessary, some Inclusions such as Wi-Fi and complimentary all-day beverages will not be provided.
  4. Virtually all countries have public holidays, religious or otherwise. The festivities may temporarily disrupt the holiday and some religious holidays may result in a reduction of facilities and entertainment.
  5. Some restaurants or facilities may be closed during the Holy month of Ramadan and religious holidays.
  6. Alcoholic beverages restrictions may apply to your pre and post Cruise arrangements during the Holy month of Ramadan and religious holidays. The Cruise ship will operate as normal.
  7. In the event that, during the Cruises, a Passenger or crew member presents symptoms and/or is diagnosed with COVID-19, the Discover Qatar shall be entitled to cancel and/or interrupt said Cruise.

 

1.8 Limitation of Liability

  1. Discover Qatar packages include the services of independent providers, such as hoteliers, Cruise companies and other operators, who are not agents, servants or employees of Discover Qatar. Although Discover Qatar takes care in selecting the independent service providers and the optional excursions conducted by some independent service providers, Discover Qatar is not responsible for the conduct of such independent service providers, their servants or agents, or for any ramifications of that conduct.
  2. Optional excursions may, depending on the holiday package, include activities such as desert safaris, climbing, exploring, swimming and snorkelling. The Passenger accepts and assumes the risk involved with these activities.
  3. If, in the opinion of any representative of Discover Qatar, a Passenger’s mental or physical condition, or general behaviour is such as to affect a Passengers own health and safety, render a Passenger incapable of caring for themselves, cause a Passenger to became a hazard to themselves or other Passengers or result in a Passenger becoming objectionable to other Passengers or staff, such Passenger will not be permitted to embark or continue on the whole or any part of the holiday package. Abuse or harassment of any kind toward crew, contracted suppliers or other guests may result in immediate removal from the tour or Cruise. Discover Qatar is not liable to Passengers for any costs associated with such decision and the Passenger will not be refunded for any part of the holiday package.
  4. Discover Qatar accepts no responsibility for any death, injury, illness, loss (including loss of enjoyment), damage, detention, delay (including mechanical breakdown) beyond its reasonable control.
  5. To the full extent permitted by law, Discover Qatar’s liability arising under or in connection with the Contract: (a) is limited to the re-supply of the products or Services under the Contract or the payment of the cost of re-supply of the products or Services under the Contract to the Passenger; and (b) excludes liability for any indirect or consequential losses suffered by the Passenger or any third party, howsoever caused, including but not limited to pure economic loss or any special, extraordinary or punitive damage to the Passenger or any other party.
  6. The travel agent will forward payments to Discover Qatar on the Passengers behalf, but such travel agent is not Discover Qatar’s agent for the purpose of receipt of monies. Receipt of deposits and subsequent payments by the travel agent does not constitute receipt of those monies by Discover Qatar and the travel agent has no authority expressed or implied to receive monies on Discover Qatar’s behalf. There is no liability on the part of Discover Qatar in respect to any monies paid to a travel agent unless and until Discover Qatar notifies the Passenger (by way of a booking confirmation advice or payment receipt advice) that the monies have been received by Discover Qatar. Discover Qatar reserves the right to cancel any Contract, or ticket or voucher issued for Services under a Contract or refuse to carry any Passenger where payment has not been received by Discover Qatar within the specified timeframe.
  7. Passengers must inform Discover Qatar without undue delay of any failure to perform or improper performance of the travel Services included under the Contract. If any of the travel Services included under a Passenger’s Contract are not performed in accordance with these Terms and Conditions or are improperly performed, by Discover Qatar or the travel Service suppliers, Passengers may be entitled to an appropriate price reduction or compensation or both.
  8. In respect of Package Travel:
    1. As the organiser of the Package Travel (as defined by the European Package Travel Directive), Discover Qatar will give appropriate assistance without undue delay to the Passenger in difficulty, more particularly by providing appropriate information on health services, local authorities and consular assistance and by assisting the Passenger to make distance communications and helping the Passenger to find alternative travel arrangements. Please note that Discover Qatar will be entitled to charge a reasonable fee for such assistance if the difficulty is caused intentionally by the Passenger or through the Passenger’s negligence.
    2. Discover Qatar promises that Package Travel arrangements will be made, performed or provided with reasonable skill and care. Discover Qatar will accept responsibility in the event of a  Passenger’s death or personal injury, or if contracted arrangements are not provided as promised or prove deficient, as a result of the failure of Discover Qatar, its employees, agents or suppliers to use reasonable skill and care in making, performing or providing Passenger’s contracted arrangements. Further, Discover Qatar will be responsible for what Discover Qatar employees and/or, agents do or not do if they were at the time acting within the course of their employment or carrying out work Discover Qatar had asked them to do.
  9. In respect of all services that do not fall under the definition of Package Travel:
    1. Discover Qatar promises to use reasonable skill and care in the performance of the contractual obligations, subject to and in accordance with these Terms and Conditions. Discover Qatar’s contractual obligations consist of using reasonable skill and care in making the booking and arranging the services under the Contract, as well as using reasonable skill and care in choosing our suppliers.
  10. In respect of all services, including Package Travel:
    1. Discover Qatar will not be liable where any failure to perform or improper performance of the travel services is due to: the Passenger or another member of the Passenger’s party; or a third party unconnected with the provision of the travel services under the Contract and is unforeseeable or unavoidable; or unavoidable and extraordinary circumstances, which means a situation beyond Discover Qatar’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken.
    2. Except as specifically set out in these conditions, Discover Qatar will not accept any further or different liability than the Package Travel Directive and its relevant transposition into National Law of European Union Member States impose. It is the Passenger’s responsibility to show that reasonable skill and care has not been used if a Passenger wishes to make a claim against Discover Qatar.
    3. Discover Qatar limits the maximum amount that may be payable for any claims made. The maximum amount Discover Qatar will pay where found liable for loss of and/or damage to any luggage or personal possessions (including money) is three times the value of the damaged/missing items (excluding insurance premiums and amendment charges) per Passenger affected unless a lower limitation applies to the claim under this clause.
    4. For all other claims which do not involve death or personal injury, the maximum amount Discover Qatar will pay if found liable on any basis is three times the value of the contracted Services (excluding insurance premiums and amendment charges) paid by or on behalf of the Passenger(s) affected in total unless a lower limitation applies to your claim. This maximum amount will only be payable where everything has gone wrong and the Passenger has not received any benefit at all from the Services under the Contract.

 

  1. Discover Qatar’s liability will also be limited in accordance with the following:
    1. Discover Qatar assumes the benefits of any limitations that apply from any relevant international convention, for example, but not limited to, the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, which limit the amount of and conditions under which compensation can be claimed and must be paid for death, injury, delay to Passengers and loss, damage and delay to luggage.
    2. Passengers may ask for copies of the contractual terms for the Services under the Contract, or the international conventions, from Discover Qatar at the details provided.
    3. Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any air, sea, rail or road carrier or any stay in a hotel, the maximum amount of compensation Discover Qatar will pay will be limited. The maximum amount Discover Qatar will pay to a Passenger, if found liable on any basis, is the maximum payable under any convention or regulation which applies to the travel arrangements or hotel stay to which the claim arises from. In any circumstances in which the carrier is liable to a Passenger by virtue of the Denied Boarding Regulation 2004, any liability Discover Qatar may have under the Contract, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) Discover Qatar were a carrier; any sums a Passenger receives from the carrier will be deducted from any amount due by Discover Qatar.
  2. Local Excursions/Activities/Events
    1. Discover Qatar will not accept responsibility for services or facilities which do not form part of the Contract or any services or facilities that are not advertised in Discover Qatar’s brochure or the website.
    2. The Services and facilities included in the Contract will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply, or, if there are no applicable local regulations, if they are reasonable when compared to the local standards in practice.
    3. Every occurrence of unavoidable or extraordinary circumstances will lead to the suspension of the obligations in these Terms and Conditions that are affected by such unavoidable or extraordinary circumstances and Discover Qatar shall not be liable as a result of any inability to meet such obligations in an event. If it is impossible to ensure a Passenger’s return as scheduled, due to unavoidable or extraordinary circumstances, Discover Qatar will bear the cost of necessary accommodation, if possible in an equivalent category, for a maximum of three nights. This limit does not apply to persons with reduced mobility and any person accompanying them, pregnant women and unaccompanied minors, or persons in need of specific medical assistance, provided that Discover Qatar is notified of these needs at least 48 hours before the start of the Services.
  3. In this Section 9 Discover Qatar’s liability will always be the lesser of the limits stated herein and the limits of the relevant Conventions or Regulations referred to herein.

 

1.9 Travel insurance

  1. The sale of Services by Discover Qatar does not include any kind of insurance.
  2. Passengers are required to purchase comprehensive travel insurance that includes (without limitation) coverage for the cost of the holiday package, medical expenses, loss of luggage, Cruise and land content and airfare charges that may occur due to cancellation, impossibility of performance or other frustration, disruption, loss of deposit or strikes.
  3. Passengers are required to check the terms and conditions of the policy to determine the extent of coverage for COVID-19 related claims.
  4. Passengers are solely responsible for taking out such insurance at their own expense. If a Passenger has not taken out such insurance, they accept responsibility and any costs linked to medical expenses, evacuation for health reasons, or repatriation.

 

1.10 Luggage restrictions

  1. All luggage is restricted to suitcases and hand luggage in sizes and models which may be easily stored in the cabin.
  2. Each Passenger may only bring one piece of luggage onboard, the maximum authorized weight of which is 20 kg.

 

1.11 Responsible Service of Alcohol

  1. Discover Qatar staff are trained in the Responsible Service of Alcohol and are obligated by law to refuse service to any Passenger who is intoxicated or behaves in an aggressive or offensive manner.

 

1.12 Medical Assistance

  1. Discover Qatar does not employ medical staff. If a Passenger requires medical attention local medical services can be contacted immediately. Passengers are responsible for the type or quality of the medical services they may require.
  2. There is a charge for medical consultations undertaken by the doctor or nurse on board the Cruise. The price can vary according to the time and place of the consultation (hospital or cabin). Any medication must also be paid for by the Passenger.
  3. As the Ship does not have any facilities for giving birth onboard, women who are over six months’ pregnant shall not be allowed to board. In any event, pregnant women travelling onboard the Ship are advised to see a doctor before boarding in order to ensure that their state of health is appropriate for the Cruise that they are planning.

 

1.13 Smoking

  1. For other Passengers’ comfort there is no smoking in vehicles or coaches. Smoking on the Cruise ship is only permitted in designated areas.

 

1.14 Currency onboard the Cruise ship

  1. The official currency on board the Cruise ship is the Euro.
  2. Upon arrival on board, an imprint of Passenger’s credit card will be required. The evening before disembarkation, an invoice detailing a Passenger’s on-board spending will be delivered to the cabin.

 

 

1.15 Tours and Activities

  1. The following terms and conditions may be applicable to the Contract:
  2. Tours or Activities are subject in all respects to these Terms and Conditions and to any and all terms and conditions of the owners, operators, public carriers and such other persons who provide Tours or Activities to the Passenger.
  3. Acquisition of a voucher or the making of a booking entitling Passenger’s to participate in a Tour or Activity shall be deemed to constitute Passenger consent and acceptance of these Terms and Conditions.
  4. If Tours and Activities are not booked by a Passenger as part of the contracted Services, Discover Qatar is authorized to cancel, modify or omit any part of any Tour or Activity with or without notice to the Passenger and at Discover Qatar’s sole discretion. Due to the nature of many of the Tours or Activities, delays and cancellations may result due to factors beyond our or our suppliers’ control, such as the weather, accidents, sickness, governmental restrictions and other events of force majeure. In such cases, a refund or partial refund may be given at Discover Qatar’s discretion and/or the discretion of the supplier of the Tour or Activity concerned.
  5. Extension of tour duration, additional services or amendments cannot be made during the tour. Pick-up and drop-off time and location cannot be changed at any time during the tour.
  6. The Passenger understands and accepts the potential risks and hazards that can be involved in some of the Tours or Activities. Passenger takes responsibility for ensuring that they are mentally and physically capable of participating in the particular Tour or Activity. The Passenger agrees to comply with the instructions in English of any personnel providing the Tour or Activity. If in the opinion of that Leader, a Passenger’s behaviour or physical condition is detrimental to the safety, welfare and well-being of the group as a whole, or if the Leader considers that the Passenger’s general well-being will be put at risk by continuing with the Tour or Activity, the Passenger may be asked not to participate in the Tour or Activity without the right to any refund of the price.
  7. Some of the Tours or Activities are potentially hazardous. Discover Qatar and its suppliers will use all their experience and, where necessary, the experience and assistance of local guides and other experts, in order to minimise the risk to the Passenger. Nevertheless, if Passenger’s are participating in Tours or Activities that are potentially hazardous or against the Leader’s recommendation Passenger’s may be required to read, understand and sign an indemnity and waiver form in English before participating in those Tours or Activities. Where Discover Qatar offer’s Tours or Activities provided by third parties, or issues Passengers with a voucher entitling Passengers to a ticket for an event and provided that the Tours or Activities are not part of a Travel Package, Discover Qatar acts only as agent for the operator of the Tour or Activity concerned or the organisers of that event. The terms and conditions of the operator of the Tour or Activity or organiser of the event will apply to the Passenger and any refund will be subject to those terms and conditions. Discover Qatar will therefore have no responsibility for the acts or omissions (including negligence) of those operators or organisers or their servants or agents, or for any injury, damage or loss arising in connection with the provision of Tours or Activities by such operators or in connection with the event or its organisation.
  8. Discover Qatar are responsible for making sure that each part of the Tour or Activity a Passenger books with Discover Qatar is provided to a reasonable standard and as was advertised by Discover Qatar (or as changed and accepted by the Passenger).
  9. To the maximum extent permitted by law, Discover Qatar accepts no responsibility for any damage, loss, accident, sickness, injury or death that a Passenger or anyone else may suffer or incur arising out of the Tours or Activities and/or in connection with the Contract with Discover Qatar and/or the operator of any Tours or Activities.
  10. Any person who is under 18 years old must be accompanied by an adult on any Tours, Excursions or Activities.
  11. Tours and Activities products purchased from Discover Qatar are non-transferable (if they are not part of a Travel Package) and cannot be sold, encashed or given away, nor can these services/travel products be used for commercial or promotional purposes.
  12. Any personal possessions left behind will be disposed of responsibly.

 

1.16 Conduct

  1. When booking Services with Discover Qatar Passengers accept responsibility for the proper conduct for themselves and their party whilst availing of such Services. For the purposes of this clause reference to a Passenger includes any other person in a Passenger’s party.
  2. All Passengers staying in accommodation booked through Discover Qatar are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other guests. If in the accommodation provider’s opinion or in the opinion of any other person in authority, a Passenger’s behaviour or that of any member of a Passenger’s party is causing or is likely to cause distress, danger or annoyance to any other guests or any third party or damage to property, or to cause a delay or diversion to transportation, Discover Qatar reserves the right to terminate the Contract immediately. In the event of such termination, Discover Qatar’s liability to the Passenger and/or the Passenger’s party will cease and the Passenger and/or the Passenger’s party will be required to leave the accommodation or other service immediately. Discover Qatar will have no further obligations to the Passenger or party members. No refunds for lost accommodation or any other service will be made and Discover Qatar will not pay any expenses or costs incurred as a result of termination.
  3. Passengers and / or party members may also be required to pay for loss and/or damage caused by their actions and Discover Qatar will hold the Passenger and each member of the Passenger’s party jointly and individually liable for any damage or losses caused by the Passenger or any member of the Passenger’s party. Full payment for any such damage or losses must be paid directly to the hotel manager or other supplier prior to departure from the Cruise. If a Passenger fails to make payment, such Passenger shall be responsible for meeting any claims (including legal costs) subsequently made against Discover Qatar as a result of the Passenger’s actions together with all costs Discover Qatar incurs in pursuing any claim against the Passenger. Discover Qatar cannot be held responsible for the actions or behaviour of other customer/guests or individuals who have no connection with a Passenger’s Contract with Discover Qatar.

 

1.17 Data protection policy

  1. Any personal data has been given to Discover Qatar for the purpose of purchasing the Services. For these purposes, Passengers authorize Discover Qatar to retain and use such data to transmit it to Discover Qatar’s own offices, suppliers, authorized agents, government agencies, other carriers or the providers of such services, in whatever the country they may be located in accordance with Discover Qatar’s Privacy Notice.

  3. Applicable Law and Jurisdiction
  4. These Terms and Conditions shall be governed by and be construed in accordance with the laws of the State of Qatar and the courts of the State of Qatar shall have exclusive jurisdiction.
  5.  
  6. Enforceability.
  7. If any portion or provision of these Terms and Conditions shall to any extent be declared illegal or unenforceable by a court of competent jurisdiction, then the remainder of these Terms and Conditions, or the application of such portion or provision in circumstances other than those as to which it is so declared illegal or unenforceable, shall not be affected thereby, and each portion and provision of these Terms and Conditions shall be valid and enforceable to the fullest extent permitted by law.
  8. Order of Precedence
  9. In the event of any conflict or contradiction between these Terms and Conditions and Discover Qatar’s general booking terms and conditions the following order of precedence shall apply:

i.    these Terms and Conditions, then;

ii.   Discover Qatar’s general booking terms and conditions.

COMPAGNIE DU PONANT: CLAUSES, TERMS AND CONDITIONS FOR PASSENGER AND CRUISE TICKETS

Important notice: These clauses are the terms and conditions that apply to your travel and/or cruise

contract. This Passenger and Cruise Ticket is a legally binding contract between you and CDP, D/B/A Paul Gauguin Cruise Inc. Please read them carefully.

Passengers’ attention is specifically drawn to the Carrier and Cruise Organiser’s rights to exclude and limit their liability, as well as to the provisions in Article 9, which set out the timeframe and conditions for submitting a claim and initiating proceedings. The use of these Tickets by the Passenger whose name appears on them, and their boarding of the ship imply their full agreement with all of these general and particular terms and conditions, which must be understood and accepted by them when they register. Representatives and agents on land and sea, and any person who was involved in the service provided by the Cruise Organiser or the Carrier may assert and benefit from the terms of these Tickets against the Passengers mentioned on these tickets If any specification in these Tickets breaches a mandatory legal provision, said specification shall be considered as null and void, however such nullity would not jeopardise the other clauses of these Tickets.

 

 

 

 

1 - DEFINITIONS

1.1 - “Cruise Ticket”: the document that contains the stipulations of the cruise contract, according to which the Cruise Operator undertakes to have the Passenger transported by the Carrier, and to provide them with the services mentioned on the Cruise Ticket.

1.2 - “Passenger Ticket”: the document that includes the stipulations of the travel contract, in accordance with which the Carrier undertakes to carry the Passenger between the ports mentioned on that document.

1.3 - “Tickets”: the Passenger Tickets and Cruise Tickets, as referred to jointly.

1.4 - “Ticket”: the Passenger Ticket or the Cruise Ticket.

1.5 - “CDP”: Compagnie du Ponant, a simplified joint stock company with a sole shareholder, which has its registered office at 408 Avenue du Prado 13008, Marseille, France, and is registered on the Marseille Trade and Companies Register under No. 344 497 011.

1.6 - “Cruise Operator”: the person who undertakes to have the Passenger transported by the Carrier, and to provide them with the services mentioned on the Cruise Ticket, and whose header appears on the Cruise Ticket.

1.7 - “Passenger”: any person whose name appears on the Passenger Ticket, and on the Cruise Ticket, where applicable.

1.8 - “Carrier”: the private individual or the company that operates the ship carrying the Passenger, and whose header appears on the Passenger Ticket.

1.9 - “Seller”: the private individual or legal entity who has sold all the services included in the cruise directly to the Passenger, potentially including the various, land, sea, and air transportation services.

1.10 - “Ship” :   the ship from the CDP fleet including the MS Paul Gauguin.

 

2 - ACCEPTANCE AND APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF THE PASSENGER TICKET AND CRUISE TICKET

2.1 - The Passenger agrees to the following terms and conditions by accepting or using the Passenger Ticket.

2.2 - The Passenger agrees to the clauses and terms and conditions of this Cruise Ticket, where the Cruise Ticket is issued by CDP.

2.2 - Where the Cruise Tickets is issued by CDP, by using or accepting the ticket, the Passenger agrees to its clauses and terms and conditions.

2.3 - Where the Cruise Ticket is not issued by CDP, the terms and conditions of the Cruise Ticket shall not be governed by these terms and conditions, but by those agreed between the Passenger and the Cruise Operator.

 

3 - LAW APPLICABLE TO THE PASSENGER TICKET

3.1 - The contractual relations between the Carrier and the Passenger are governed by French law and specifically governed by the provision of the French Transport Code, especially its Articles L. 5420-1 to L. 5421-12 and by the Decree of 31 December 1966, as well as by the provisions of the International London Convention of 19 November 1976, and, where applicable, by the provisions of Regulation 392/2009 issued by the European Parliament and Council, which form an integral part of the Passenger Ticket.

 

4 - LAWS APPLICABLE TO THE CRUISE TICKET

4.1 - Where CDP is the Cruise Operator, the contractual relations between the latter and the Passenger regarding the organisation of the cruise are governed by Articles 47 to 49 of Law No. 66-420 of 18 June 1996 regarding chartering and sea transportation agreements, and by the provisions of the Application Decree dated 31 December 1966.

 

5 - PAYMENT OF THE PRICE

5.1 - The price of the Passenger Ticket and of the Cruise Ticket must be paid to the Seller in accordance with the General Terms and Conditions of Sale, understood and accepted by them when they register..

5.2 - Where the Passenger puts an end to their cruise either wilfully or by reason of their actions the price of these Tickets will not be refundable.

5.3 - The price initially proposed may be amended in the event of the following exceptional circumstances: governmental action, a significant fluctuation in the US dollar or euro exchange rates or of special drawing rights, a significant increase in the oil price, or any other factor that significantly alters the cost of transport, and is beyond the Carrier’s control. Any increase decided in this way shall be calculated in accordance with the overall surcharge payable by the Cruise Operator and/or the Carrier, divided by the estimated number of Passengers, and shall include the commissions payable to agents. The Passenger or the person who purchased the Ticket(s) shall be informed of the increase in the price of the Ticket via registered letter with acknowledgement of receipt – or via any other means that enables actual receipt of the correspondence to be proved – with a 30 (thirty) day notice period prior to the departure date. The Passenger and/or the person who purchased the Ticket(s) may cancel their contract when they receive this notice, and obtain the immediate refund of the amount paid with no penalties by informing the Seller in writing within a period of 7 (seven) days following receipt of notice of the increase.

5.4 - Save for the exceptions set out in the cruise itinerary, or in the Cruise Ticket, excursions are not included in the Cruise Ticket price. They are exclusively sold and invoiced onboard, and are governed by the general terms and conditions applicable to the contract signed with the local operator providing the services. Excursions cannot be refunded in the event that the client cancels them once they have registered.

5.5 - Any expenditure incurred onboard by the Passenger, or on their behalf, shall not be included in the Ticket price; such expenditure must be settled in cash and in any event before the Passenger leaves the ship.

 

6 - BOARDING AND TRANSPORTATION TERMS AND CONDITIONS

6.1 - The Passengers must present themselves for boarding in accordance with the conditions determined by the itinerary, and at least 2 (hours) before the scheduled departure time. The Passengers must present themselves for boarding in accordance with the conditions determined by the Passenger Ticket. In the event that they are late or decide not to travel, the Passengers shall still be liable for the price of the Cruise Ticket and of the Passenger Ticket.

6.2 - Tickets shall be issued in the name of the Passenger. The Passenger may not transfer their Tickets to a third party for any reason whatsoever.

6.3 - Each Passenger shall warrant that they are fit to travel by sea, and that their state of health or their behaviour shall not harm the other Passengers or the proper running of the trip. If a Passenger’s state of health is likely to restrict their ability to go on the planned sea journey, or to disrupt the proper running of the trip, they shall inform the Carrier and the Travel Organiser, or the Seller, where applicable, and shall produce a medical certificate providing evidence of their fitness to travel on request.

6.4 - All Passengers must be in possession of a valid passport, or identity card, where applicable, as well as of the visas and vaccination certificates likely to be required at ports of call, and when the ship reaches its destination. Each Passenger shall be personally responsible for complying with the legal and regulatory specifications required before departure. The Carrier, the Cruise Operator and/or CDP may refuse to let a Passenger who does not show a document authorizing them to disembark at the destination and at the scheduled ports of call.

6.5 - Passengers with limited mobility, due to a physical disability or to a condition that requires special treatment and/or assistance, including people who use wheelchairs, must inform the Seller and the Carrier in writing a) at the time when they make the booking request, or b) as soon as the Passenger becomes aware of their disability, if that disability occurs after their booking, but in any event at least 30 (thirty) days prior to the boarding date, primarily in order to ensure that the Carrier is in a position to give the Passenger a confirmation that they will actually be able to take the cruise onboard the ship. The Organiser of the Cruise, the Carrier and/or CDP reserve the right to refuse access to Passengers who have failed to inform the Carrier and the Seller of such disabilities or need for assistance, if the Passenger’s state of health is not compatible with the applicable safety regulations, or if the design of the passenger ship, and the port infrastructure and equipment, including the port terminals, make it impossible for the Passenger in question to board, disembark or be carried under secure conditions, or conditions that are achievable from an operating standpoint.

The “Ponant” sailing ship does not allow access to persons with limited mobility or in wheelchairs.

6.6 - Disembarkation at some ports may be hard or even impossible for Passengers with limited mobility, particularly in the case of disembarkation by rowing boat and/or excursions in dinghies. Passengers who use wheelchairs must have their own wheelchair and be accompanied by someone who is able to assist them.

6.7 - The Passenger must comply with the onboard rules throughout the trip. The Passenger shall be required to attend all safety demonstrations and explanations that may be organised onboard,

and to follow the crew’s instructions at all times.

6.8 - If they consider it to be necessary, the Carrier, the Cruise Operator and/or CDP and/or the Captain of the Ship may terminate the contract, and refuse to transport any Passenger who does not meet the conditions for entry into port-of-call countries, or whose presence onboard might jeopardise the comfort, health, and security of the other Passengers, the crew, the laws and regulations of the ports visited by the ship, or who might make the Carrier, the Cruise Operator, and/or CDP liable for their keep, defence or repatriation. On these grounds, the Cruise Operator, the Carrier and/or CDP and/or the Captain of the ship may also decide to take the following appropriate measures:

- refuse to let the Passenger or Passengers board or disembark in any port in which the ship calls;

- Disembark the Passenger or Passengers in any port in which the ship calls;

- Transfer the Passenger or Passengers to another ship;

- Confine the Passenger or Passengers onboard, to their cabin, or to a cabin attached to the onboard medical team;

- have the doctor or their team administer any drugs or medication, or any other permissible substances, and/or confine the Passenger to hospital or any other similar institution in the destination ports of call if the onboard doctor considers it necessary. The Passenger shall bear the costs of the treatments and the medication on land or onboard.

6.9 - In the event that there is a risk of an epidemic, the Carrier, the Cruise Operator and/or CDP, and/or the Captain of the ship, and/or any local healthcare authority may require the Passenger to answer a health questionnaire, as well as to submit to a screening test before or at the time of boarding or disembarking, including at the ports of call.

6.10 - Goods, property and items where the content may threaten the health and safety of people and property, damage or pollute the ship, inflammable, explosive, corrosive, hazardous, or odorous materials, materials likely to leak, items where import is prohibited or that are not compliant with customs or police regulations, and generally speaking any property and items other than those intended for the Passenger’s personal use are prohibited onboard and in luggage (hereinafter the «Prohibited Items»). The Passenger shall be responsible for any injury, loss or damage suffered as the result of the presence of Prohibited Items in their luggage or in their cabin, and shall hold the Cruise Operator, the Carrier and/or CDP harmless against any proceedings that may be initiated against them due to the presence onboard, or loading or unloading of these Prohibited Items. These Prohibited Items may be unloaded, destroyed, thrown overboard, or rendered harmless at any time and in any place by the Cruise Operator, the Carrier, the crew and/or CDP, with no indemnity, and notwithstanding the payment of any potential destruction costs by the Passenger.

6.11 - Each Passenger may bring aboard the Ship a reasonable amount of clothing and personal effects without charge. Passengers should, however, take into account any limitations on the number, size and weight of luggage that may be imposed by airlines and other transportation used by Passenger. All baggage must be securely packed and distinctly labeled with the Passenger's full name, the name of the Ship, the cabin number of the Passenger and the sailing date of the Ship.

6.12 - The Passenger shall agree, upon request and without delay, to allow free access to their cabin, their luggage and their personal effects to the Cruise Operator, the Carrier, the crew officers and/or CDP, as well as to the customs, healthcare and/or administrative authorities in the countries where the ports of call are located, or the country where the ship is registered.

6.13 - The Passenger must oversee their luggage and personal effects during their stay onboard, as well as during boarding, transshipment, and disembarkation operations. The Cruise Operator, the Carrier and/or CDP shall decline any liability for any luggage left unsupervised by the Passenger, and for which the latter has not taken all the necessary precautions to avoid theft, loss, or damage.

The Cruise Operator, the Carrier and/or CDP shall not be liable for the loss or theft of money, cash, marketable securities, jeweler and other valuables that the Passenger has not declared as valuables, entrusted to the onboard staff with a descriptive inventory including estimates, and for which they have not paid the corresponding proportional custody duties.

6.14 - The Cruise Operator, the Carrier and/or CDP shall not be liable for the damage caused to cameras, telephones, electronic devices, and video cameras that are lost or damaged onboard the ship and in its ancillary tenders/shore facilities, or during boarding and disembarkation operations, or for the damage caused to items that have fallen overboard.

6.15 - Pets and other animals are not allowed onboard the ships.

6.16 - The Passenger shall be civilly and criminally liable for any direct or indirect damage that they cause to the Cruise Operator, the Carrier and/or to CDP, and to other Passengers or to third parties. They shall be solely liable for any fine or penalty imposed by the relevant authorities due to their actions.

6.17 - For passenger safety, smoking is not permitted in staterooms or on balconies. Smoking is only permitted in specifically designated areas on the Ship.

 

7 - PREGNANCY AND CHILDREN

7.1 - Children under three shall not be allowed to board. Children aged between three and eight can only board on presentation of a boarding authorization, which shall preferably be requested as soon as the child is registered as a Passenger and must be shown at the time of boarding under all circumstances, otherwise the Cruise Operator, the Carrier and/or CDP shall not be able to allow the child onboard.

Except for the M/S Paul Gauguin, children under twelve (12) months shall not be allowed to board.

Any child under the age of 18 must be accompanied by an adult over the age of 21. If the adult accompanying this child is not a parent, a "Parental Consent Guardianship Form" must be signed by parent or legal guardian and received by Company prior to sailing.

7.2 - Children shall remain under the full and entire responsibility of their parents or guardians when they are onboard and/or on an excursion.

7.3 - As the ships do not have any facilities for giving birth onboard, women who are over 26 weeks months’ pregnant shall not be allowed to board. In any event, pregnant women travelling onboard the ship are advised to see a doctor before boarding in order to ensure that their state of health is appropriate for the cruise that they are planning. Moreover, no pregnant woman will be allowed to embark on cruises to Antarctica, of the North-West Passage or on Ocean Voyages.

 

8 - CANCELLATION, INTERRUPTION OR ALTERATION OF THE TRIP

8.1 - In the event of an impediment caused by a force majeure event, or the death of the Passenger, the contract shall be terminated via the notice given by the Passenger or their beneficiaries before boarding. One quarter of the price of the Tickets shall then be payable by the Passenger. The same conditions apply to the members of the family of the Passenger who is prevented for the same reasons, from travelling or has died, and who were due to travel with them.

8.2 - Unless CDP agrees more favorable conditions in a separate agreement or in its general terms and conditions of sale, the Passenger shall remain liable for the price of the Tick
